Since I know certain prying eyes will read this post after I submit it, I think it's only fair to let the readers know that certain events that occurred yesterday afternoon.
First off, Denise and Bob, no where in my conversation with Bob last night did I say that I was NOT going to pay what was owed. When Bob confronted me with the bounced check I had tried to explain to Bob what had happened. I wrote the check on December 31,2011. At the time I wrote that check I had more than over $1200.00 dollars in my checking account according to my online banking statement. I even verified it with the bank by calling the customer assist hotline to be sure. It wasn't until three days later that I got a call from my bank stating that the check I had written had been returned due to NSF. I asked them to give me a total and somehow my account had accrued 800 dollars worth of NSF charges which brought my account balance down to $400.00. I had no idea why that had occurred since most of our bills get automatically deducted from our account. It seemed that there was a bank error that they had not caught which allowed our account to be overdrawn. Apparently, there was something called an opt in that allows companies to tap into your account as many times as they want until they receive the money owed them. I did not sign in for this option or recall ever signing in for this particular option. Hence all the fees...
I had to go through all the red tape to see if somehow i could recoup my losses from all these fees that were assessed. We were told that they could not be refunded even though the bank was in error. I had tried to explain this to Bob on Friday morning but he wasn't listening to a word I said. When he told me how much we would now owe, I said to him that it would be no problem...that we would pay by Cashier check the $870.00 PLUS the $25.00 fee PLUS the bank fees accrued... I never said I was NOT going to pay them, Denise. I specifically told Bob that he would have all his money by the end of the month in a Cashiers check. We had no problem with that the last time we had to do it that way. I told Bob that since Dennis and we were expecting a paycheck PLUS a big income tax return, that would more than make up for the money lost, that it was no problem. When he left, I thought that we had an understanding that this is what was going to resolve the issue. Apparently, I was wrong. WE WILL BE PAYING ONLY $770 PLUS THE $25 RETURNED CHECK FEE AS STATED ON THE LEASE. NO BANK FESS SINCE IT'S NOT CLEARLY STATED ON THE LEASE.
That night, Bob again came to my door asking us what we were going to do about the bounced check. I had repeated to him what I had told him earlier that day to which Bob began to get agitated saying he wasn't there to argue with me. I told him fine then don't argue and to go back to his apartment. At this point, I figured there really was no sense in arguing myself so I told him goodbye and closed the door, which he had tried to force back open to continue the argument. Again, Denise, no where in the course of the conversation did I say I was NOT going to pay. When Bob had inquired as to what I planned on doing about the bank fees...yes, I did say what about them. I thought it was clear that I did intend to pay them that morning and this was just Bob wanting to pick a fight and argue with me some more. When I decided to end the argument by asking him to leave, he became belligerent and verbally abusive. To be honest, when someone gets to that point I see no reason to continue communicating with them. I figured I would let him calm down and if he wanted to talk to us he could do so after he decided to calm down and talk to us like an adult instead of ranting and raving at us. Sorry Denise, I just don't tolerate being yelled at or verbally abused same as yo don't tolerate it.
Now as to the matter pertaining to the public forum http://www.landorslum.com/landlords/bob-rosato : I was completely unaware of what Dennis had posted on that site until yesterday afternoon when both you and Bob came banging down our door. Denise, I have told you that as far as Dennis and I go, that I do not control what Dennis does or says. His opinions are completely his own and do not reflect how I feel. I had asked Dennis why he would post that in a public forum for all to see. Personally, that was over the top. I can understand how you would be frustrated by that post. If I was in your shoes, yeah that would probably get me a bit hot under the collar.
However...HOWEVER...things would have gone a bit more smoothly if Bob or Dennis were not present and it was just you and I discussing the issue. I felt that back in August we had at least bridged a little bit of that gap in working things out. I felt a bit more comfortable dealing with you rather than having Bob screaming and yelling at me. When you both came down banging on the door and screaming and yelling and verbally harassing us and shouting expletives at us, it kind of puts up a barrier around me and cuts off all communication efforts. I even do this when Dennis starts yelling at me or getting on my nerves. I don't communicate well with people who like to talk me down or shout and scream at me. Dennis was the one who called 911 because he had said that Bob had verbally threatened him and that he saw that Bob had his fist cocked back and was trying to get at Dennis to punch him. I didn't see that happening since Bob was not in my line of sight. I can only take Dennis' word for it.
I'd be the first to stand in line to defend someone's Constitutional right to say what they want to say or post what they want to post on the internet. After all, the internet is a free marketplace to exchange ideas and opinions. However, when I went back on the forum and saw what you and Bob had posted...yeah I gave you two kudos. However, I found this a bit disturbing and WAY over the top:

Seriously...really??? You think that I just pretend to be sick to win sympathy points? You think that I like to have IV's and tubes shoved up my nose and down my throat? You think that I liked being put into a chemically induced coma for three days just so I could "pretend" to be sick? To be quite honest, I don't even know how to RESPOND to that or even if I SHOULD respond to that. Oh and yeah...I like having my days interrupted by nurses coming in and out of the apartment trying to get my speech back and learn how to walk with a cane and such...it's the kind of attention I crave all the time. I can't IMAGINE anyone wanting to go through that sort of hell just to garner sympathy. Being in a chemically induced coma for three days is a very hellish experience I wouldn't even wish on my worst enemy. But that is neither here or there...the point is I don't get the notion as to where you got the idea that my being sick was all an act...and it just paints you out to be a very callous person in regard to those who have health issues. You have NO idea as to the extent of my health issues or the serious side effects of some of the medications I take to keep me from having strokes and aneurysms. For you to sit in judgment like that and say that it's all an act is about as low as I have seen you go.
And for the record: Dennis and I DON'T think it's OKAY to bounce checks and not pay fees. As I said before, there was nowhere in the course of my conversation with Bob that Friday that gave any indication that we were NOT going to pay the money. I said it would be no problem...that we wold pay with a cashier check...no problem. Or did Bob not tell you that? This is why I don't like dealing with Bob...either he doesn't take the time to really listen to what I am telling him or he just doesn't care to.
Most...and I say MOST landlords try to work with you instead of against you. They understand that sometimes things happen in the course of the month that are beyond your control and they work with you. I don't recall ONE time that we were ever "SLUM tenants" that we NEVER gave you your money. We have sold personal items and possessions to get money to you so that we could continue to stay. WE have held garage sales at a friend's house to sell items for money to give to you...so how are we then SLUM tenants?
One month's check and we're the bad guys? If we were such the "slum" tenants that you say we were then you would not have rented out to us for the last five years we have been here, now would you have? It's only NOW that things have gone south...just as the Magistrate said at the last hearing. Did you bother to tell your fellow landlords THAT little tidbit of information...as all these other people say...there are always two sides to every story.
Seriously, if you really want to go in that direction, we can do that. I could take pictures and video and show to the Magistrate the three windows that your husband has been promising for the last five years that he was going to fix to keep the heat from escaping. And how about that back patio door? your husband has seen it quite a number a times and has admitted that yes it needs replaced. Has it been replaced? Last time I looked at, it was still the same back door.
There's a screw in the middle of the hallway in our apartment that holds down a piece of tile. The screw keeps popping up and I have to keep screwing it back down so I don't cut my feet on it like I had happen the last time. For me, being a diabetic, I have to be careful about my feet so as not to get cuts or deep nail wounds since that could seriously lead to infection and gangrene in diabetics.
Speaking of which, the deck has a lot of exposed nails on much of the banister and on some parts of the deck floor that I have had to take a hammer to and nail back in...the hallway in our apartment is starting to bow up a bit because I can feel a bit of a bump in the middle of the hallway when I walk down it. Not that it matters now since you both have decided that you don't want us around anymore...but I figure I'd give your husband a working to do list before he decides to rent the apartment to another tenant because I'm sure they will probably notice the same things we did.
